Editorial In ACM On Open Access Publishing In Computer Science

Well done! Since you are already doing this, have you thought about signing the Cost of Knowledge [thecostofknowledge.com] petition if you haven't already done? In theory, this will prevent at least Elsevier editors from asking you to review in the first place and hopefully help establish more momentum for change.

In my experience with declining requests to review, I have commonly mentioned access and/or price as concerns for declining and have found some sympathy with various editors. If this becomes more commonplace, hopefully

Matt Riddle cut from the UFC after second positive test for marijuana

Last week, Matt Riddle talked about how he mended fences with UFC brass over his positive test for marijuana. This week? He tested positive again and lost his job. According to MMA Junkie, Riddle tested positive for marijuana after his UFC on Fuel 7 bout with Che Mills, and was then cut from the UFC. Riddle also tested positive at UFC 149.

While it's true that Riddle has a medical marijuana card in Nevada, he knew full well that the UFC tested for the drug. Whether that drug should be banned is not the point. It is, Riddle knows it's banned, and Riddle broke the rules.

If your boss banned red shirts for no reason at all and you were suspended for wearing your favorite red shirt to work, are you going to wear it again? Yes, you can talk about how your boss is crazy for banning red shirts and work to change his mind on red shirts, but you can't wear the shirt and expect to slide by.

It's also important for UFC fighters to walk the line these days as the promotion looks to trim their roster. UFC president Dana White recently noted that they have approximately 100 fighters to trim from their roster. Riddle made it too easy for them to pick his name.

UPDATE: The UFC released a statement on Riddle's release, which reads in full:

Matthew Riddle tested positive for marijuana metabolites following his bout at UFC on FUEL TV 7 in London, England on February 16, 2013. This is Riddle?s second failed drug test for marijuana within the past seven months. Riddle previously failed a post-fight drug test due to marijuana following his UFC 149 victory over Chris Clements.

As such, the UFC organization is exercising its right to terminate Riddle for breach of his obligations under his Promotional Agreement as well as the UFC Fighter Conduct Policy. The UFC organization has a strict, consistent policy against the use of any illegal and/or performance-enhancing drugs, stimulants or masking agents. The outcome of the bout against Che Mills was changed to a no contest and the results of the positive test will be reported to the official Association of Boxing Commissions MMA record-keeper.

WILMINGTON, Del. (AP) ? Pageant officials say Miss Delaware Teen USA has resigned amid allegations she appeared in an online sex video.

But Melissa King says she's not stepping down because of the sex video that has surfaced. King, who is 18, told The (Wilmington) News Journal (http://delonline.us/12a6FM2) she was aware of the video, but denies appearing in it.

Pageant officials say King is being represented by Hagerstown attorney J. Gregory Hannigan. The attorney told the newspaper that a statement on the resignation will be issued.

Pageant spokeswoman Dara Busch says the pageant's runner-up will replace King. The pageant's website lists Hailey Lawler of the Newark area as the 2012 runner-up.

China considers overhaul to streamline government

BEIJING (AP) ? The Ministry of Railways operates ultramodern bullet trains but its singular focus on rail at a time of booming car ownership and air travel makes it a relic from an era when 100 ministries ran China's planned economy.

That could soon change. China's new Communist leaders are considering another shake-up of a sprawling bureaucracy that has added market regulators and shed agencies that once dictated prices and told companies what to produce.

Modernizing the rail ministry ? a Soviet-style behemoth with 2.1 million employees, its own courts and police and 1.7 billion passengers last year ? by making it part of a transportation "super ministry" would be a likely priority.

Such change would be politically fraught since it threatens top jobs and influence, the lifeblood of party factions. And it could require years to complete. But reformers say it is urgently needed to keep the world's second-largest economy growing strongly.

"If the new leaders want to demonstrate they are in charge, they want to break the logjam, then this is a great time," said Dali Yang, a specialist in the Chinese government at the University of Chicago.

Though details of the streamlining have yet to be announced, General Secretary Xi Jinping and other Communist Party leaders opened a three-day meeting Tuesday to discuss a reorganization plan, state media reported. The closed-door meeting of the Central Committee will also approve the appointment of top government officials who will be publicly announced early next month at the annual session of the ceremonial legislature. That will complete a power transition begun in November when Xi was installed as party leader.

A goal of the government consolidation is to create "super ministries" that pull together a jumble of agencies with overlapping duties in broad fields such as transportation, media, energy, finance and health.

Under scenarios discussed in official media, the Ministry of Railways might be united with agencies that oversee road and air travel.

The Ministry of Culture might absorb regulators for film, publishing and TV, where boundaries have been blurred by the rise of Internet- and mobile phone-based media. The hated family planning agency, which enforces China's birth limits, might be folded into the Ministry of Health.

The potential impact on private and foreign companies is unclear, but American and European business groups regularly urge Beijing to simplify regulation and approval processes they say slow investment and hamper operations.

China has undergone repeated bouts of government restructuring to keep pace with a changing economy.

In 1982, the number of Cabinet-level ministries and commissions was slashed from 100 to 61. In the 1990s, museum pieces such as the Ministry of Machine Building that were no longer needed to set prices and tell companies what to produce were eliminated. In 1998, then-Premier Zhu Rongji shrank the number of ministries further from 40 to 29.

At the same time, Beijing created Western-style regulators for banks and securities. A Ministry of Commerce was formed in 2003 to bring together trade and planning agencies, simplifying some trade regulation to make it easier for private sector traders to function.

Such change can provoke furious opposition. In the last round of proposed reforms in 2008, the only thing leaders finally agreed on was to make the environmental regulator a full-fledged ministry in response to an avalanche of pollution scandals.

Creating fewer, bigger ministries would fit with party pledges to make the economy more productive and keep incomes growing. Xi has called for a "renewal of the Chinese nation," raising hopes a new leader whose attitude toward reform is still unclear might throw his political weight behind remaking the government.

There is, however, no indication the restructuring will affect state-owned companies that dominate most major industries including telecommunications, banking and oil and have direct ties to the top ranks of the party. That will blunt the impact of the restructuring on making markets more competitive and productive.

If leaders take action, they are likely to produce no more than one or two concrete proposals to start, and that might not be until August, said a European diplomat who follows the internal workings of China's government.

And if they fail to release firm plans before the party's plenum late this year, that will suggest they have failed to agree, said the diplomat, who asked not to be identified by name because he was not authorized to talk to reporters.

In a reflection of political resistance, the Chinese business magazine Caijing says proposals to group together "big energy," ''big culture," "big finance" and "big system reform committee" were dropped from a draft plan.

And merging rival agencies into one big ministry is no guarantee factions that run them will cooperate.

The World Bank and a Cabinet think tank warned last year growth will deteriorate if Beijing fails to act quickly to curb the dominance of state industry and nurture private companies that generate jobs and wealth. Reformers say ministries that operate their own companies, giving them incentive to suppress private competitors, must be stripped of commercial interests and turned into neutral regulators.

The Ministry of Railways is the biggest example of regulatory throwbacks reformers say must evolve for China to thrive.

In an echo of the 1960s, when ministries were powerful, self-contained empires, it still operates its own police force and courts. Other state entities shed such non-core functions years ago. Its spending is huge; last year's capital spending plan was 745 billion yuan ($115 billion) ? comparable to the 670 billion yuan ($105 billion) military budget.

The ministry has built the world's biggest bullet train network but China's poor majority can't afford it and slower lines are crowded. Cargo service is expensive and inflexible, a dangerous bottleneck for a major trading economy.

The political opening for change might have come when the powerful railway minister, Liu Zhijun, was dismissed in February, 2011, amid corruption allegations. Later that year, a collision between two bullet trains that killed 40 people fueled demands for the ministry to be more responsive to public needs.

Rumors swirling around the fate of media regulators highlight potential pitfalls of consolidation.

The infant online and mobile entertainment industry flourished while regulators refrained from enforcing controls that limit the ability of traditional broadcasters to show foreign programs and other popular material. Change might simplify rules but also could bring more censorship and other controls that might hold back a promising industry.

Your health: perfect and intact?

A Christian Science perspective.

Now, before you conclude that this is a preposterous statement, let me explain.

The conventional way of thinking is that life is material, that we develop over time, having our own thoughts and bodies ? and thus our own state of health ? all of which are governed by genes and by our life experience. According to this way of thinking, we live biologically and are governed by organic laws that dictate that illness is normal and self-evident reality. Logically then, at best we try to manipulate the body with surgery or drugs or with less invasive methods such as physiotherapy or change of diet.

But instead of considering that all that I?ve just described is reality, could it be that it?s actually a state of consciousness, a way of thinking that we may have unwittingly adopted but that we can consciously change?

The founder of the Monitor, Mary Baker Eddy, contributed not only to journalism but also to health and health care. Sick for years, she teetered between living and dying. But in the Bible, her solace, she saw that the healings of Jesus were not miraculous but a natural expression of his understanding of the true nature of health. In the 1860s, when she was in her late 40s, she came to understand her way out of the health theories prevalent at that time. This restored her health, allowing her to serve society vigorously for another four decades. She began to teach this understanding, both in person and through her books. (Her main work, ?Science and Health with Key to the Scriptures,? was first published in 1875.) Soon, many of her students were practicing this method of healing, and teaching others, too. Her method of healing is not faith healing as it?s popularly known. Rather, it?s based on deep spiritual insights about the nature of identity, insights that Mrs. Eddy found in the Old and New Testaments of the Bible.

Eddy, a keen observer of human thinking, identified the kinds of thoughts that lead to illness. She saw that sickness is an unnatural, unconscious deviation from the perfection of God and of each one of us as His image and likeness. She came upon a place in thought at which individuals adopt a concept of themselves that leads either to discord and sickness or to holiness and health. She discovered that everyone can become aware of their thoughts and respond obediently to thoughts from God, those thoughts being spiritual, pure, and healthy. For her, mental self-awareness is key ? just as knowing how you?re spending money is essential to sound personal finance.

Most especially, Eddy discovered in the Bible that there?s a reliable source for healthy thoughts ? God, the one divine Mind ? that knows each of us, God?s children, as spiritual, perfect, free, and well. This fundamental truth, though not visible physically, gives each of us a strong platform from which to claim and even demonstrate that we are healthy.

Try this: Instead of assuming that you?re largely a set of body parts that can become ill, feel your oneness with this purely good, infinite Mind as its spiritual reflection. Start from the standpoint that your health is intact because goodness and wellness are inherent in this one infinite God that you reflect. This way of thinking has made a vast difference in my life, giving me both a more moral approach to living and better health. It can do the same for you.

Elephant Seals Help Find Missing Piece in Global Climate Puzzle

The tagged animals traveled to and took measurements from a fourth known source of bottom water, a crucial oceanic heat-sink

elephant seal Southern elephant seals fitted with satellite-linked instruments similar to the one above helped oceanographers map deep currents off Antarctica. Image: Flickr/Census of Marine Life E&O

By tracking the voyages of elephant seals off Antarctica, and with the help of satellite imaging and undersea sensors, researchers have discovered a long-elusive source for the deep-ocean streams of cold water that help to regulate the Earth's climate.

Antarctic bottom water (AABW) is cold, highly saline water that forms near the shores of Antarctica. Being denser than typical seawater, it sinks to the depths and then moves north in sluggish currents that spread across the globe.

Three sources of AABW were known until now. The first, in the Weddell Sea, was found in 1940; two others were found in the Ross Sea and along the Ad?lie Coast of East Antarctica in the 1960s and ?70s. But for years, researchers have suggested that these were not the only ones. In particular, water samples from an area called the Weddell Gyre contain atmospheric pollutants known as chlorofluorocarbons (CFCs), indicating that the deep water came into contact with the air far too recently to have been carried there from one of the known AABW sinks.

Now, Kay Ohshima, a physical oceanographer at Hokkaido University in Sapporo, Japan, and his colleagues have traced that water to a fourth AABW source, in the Cape Darnley polynya. Their results are published today in Nature Geoscience.

Polynyas are regions of open water near sea ice that are kept from freezing by wind and currents that sweep newly formed ice away. Polynyas have relatively high salinity, because most of the salt in sea water is expelled as it freezes.

Armed with the hypothesis that the missing source might be such a polynya, the researchers used satellite sensors to hunt for polynya regions where ice formed particularly rapidly. When satellite data suggested that Cape Darnley might be a candidate, the researchers moored instruments on the seabed, hoping to spot the descending current. In addition, they relied on data from elephant seals (Mirounga leonina) tagged with instruments that monitor ocean conditions.

?The seals went to an area of the coastline that no ship was ever going to get to, particularly in the middle of winter,? says Guy Williams, a physical oceanographer at the Antarctic Climate and Ecosystems Cooperative Research Center in Hobart, Australia, and a co-author of the study.

The elephant seals confirmed the researchers' hunch. ?Several of the seals foraged on the continental slope as far down as 1,800 meters,? he says, ?punching through into a layer of this dense water cascading down to the abyss. They gave us very rare and valuable wintertime measurements of this process.?

The new finding fills a gap in researchers? understanding of the Southern Ocean?s role in global climate, ?including carbon dioxide, temperature, the stability of the Antarctic ice sheet and changes in sea level", says Richard Alley, a geophysicist at Pennsylvania State University in University Park, who was not part of the study.

Still, Williams and Ohshima say that the Cape Darnley polynya represents, at most, about one-eighth of the world?s AABW, and that other, similar sources might remain to be discovered.

Michael Meredith, a polar oceanographer at the British Antarctic Survey in Cambridge, UK, who wrote an accompanying commentary on the study, says that if the total rate of AABW formation declines, the resulting changes in cold-water circulation could have important effects on global climate, letting the ocean depths warm and thereby changing the rate of heat exchange between Antarctica and the tropics. Moreover, he says, sea levels could rise ? owing to the fact that water expands as it warms ? and temperature changes could affect deep-sea ecosystems.

NVIDIA Tegra 4 benchmarked, breaks all sorts of speed records (video)

NVIDIA Tegra 4 benchmarked, breaks all sorts of speed records video

When NVIDIA unveiled Tegra 4 back at CES, we scrambled to get hands-on with a reference device. And though our initial performance impressions were positive -- it runs 1080p video and games smoothly -- there was only so much we could say to illustrate how fast the performance is. After all, Tegra 3 already does a fine job handling games and full HD movies. What we really needed were benchmarks, some quantitative data to help show the difference between Tegra 4 devices and whatever's currently on the market. Fortunately for all of you, we just got our chance: here at Mobile World Congress, the company has reference tablets set up expressly for the purpose of running tests. So, we did just that... over and over and over until we had a long list of scores. Meet us after the break to see how it fared.

Police Say Facebook Post By LEX 18 Helped ID Child Found In McDonald's Parking Lor

Corbin Police said Friday that the posting of a picture of a child who was found at a McDonald's parking lot in Corbin Thursday afternoon on LEX 18's Facebook page is what helped identify him.

Police say the grandmother of the boy, who has custody of the four-year-old, thought her daughter-in-law was with the boy and vice-versa. Joanne Lowe, 62, was charged with endangering the welfare of a minor. Investigators said the child has been placed in custody of the state.

An aunt of the child, whose name has not been released, contacted police after seeing his picture on LEX 18's Facebook page.

The child was standing outside in the parking for 15 minutes, according to police.

The family lives a few miles outside city limits, police said.

Former EWU football player sentenced for assault

by KREM.com

Updated yesterday at 3:38 PM

CHENEY, Wash.--- The Eastern Washington University football player accused of rape plead guilty Wednesday to second degree assault.?

Dalis Burce ws sentenced to 9 months and will have a restitution hearing on September 1.

EWU announced back in August that Bruce was suspended from the athletic program pending investigation into a sexual assault arrest. Bruce faces charges of second degree rape and residential burglary.

Court documents say the incident took place in Pearce Hall, right behind Roos Field.

Saturday night, the 17-year-old victim and three friends drank a large bottle of vodka according to court documents. The victim became intoxicated, and witnesses said she started vomiting, collapsed and passed out.

Friends put her in bed according to witnesses. Bruce allegedly entered the victim's room, found her unconscious, removed her clothes from waist down, and had sex with her.
?
The victim?s friends claimed she was unconscious until after the assault took place.

Witnesses say they interrupted Bruce having sex with the unconscious girl, and told him to leave.

Officers found the victim on the bed and unresponsive. Officers shook her several times to get a response. Officers gave the victim a preliminary breath test around 7 a.m. and she registered at .080.

The victim gave police the suspect name of "Dalis" and said she did not remember what happened.

Bruce said he met the victim through friends earlier that day. Bruce originally denied seeing her asleep in her room but later admitted he found her asleep sometime after midnight. Bruce stated that he assumed she was drunk because she was asleep and admitted to fondling the victim, but claimed he did so with her assistance. Bruce also admitted to having sex with the victim and claimed they did not talk to each other the entire time.

Sexting and bugging revealed at the FBI: CNN

(Reuters) - One FBI employee was fired for sleeping with a drug dealer and lying about it under oath, while another got the boot for bugging the boss's office.

The FBI suspended for 10 days still another employee for emailing a nude photograph of herself to her ex-boyfriend's wife - the bureau showed compassion for the woman after she sought help for depression.

Those cases over the past year were among 29 revealed by CNN on Friday after the cable news network obtained an October 2012 quarterly report the U.S. Federal Bureau of Investigation sent to all its employees that was meant to educate FBI staff but not to be disseminated publicly.

The so-called quarterlies summarized cases investigated by the bureau's Office of Professional Responsibility.

"We have seen a rash of sexting cases and nude photograph cases, you know, people misusing their BlackBerrys for this reason, and we hope getting the message out in the quarterlies is going to teach people you can't do this stuff," FBI assistant director Candice Will told CNN.

An employee who used a government-issued BlackBerry to send sexually explicit messages to another employee received a five-day suspension. Another who used a personal cell phone to send nude photographs to several other employees received a 10-day suspension, in part because the conduct created office gossip.

"When you're given an FBI BlackBerry, it's for official use. It's not to text the woman in another office who you found attractive a picture of yourself in a state of undress," Will said.

Many of the cases involved sex, such as that of the employee who visited a massage parlor and paid for a sexual favor from the masseuse. That resulted in a 14-day suspension instead of a more severe penalty because the employee had an exemplary work record and expressed remorse, the FBI documents said.

Others were more serious, such as the case of the employee who admitted purchasing and viewing video of naked boys. That person was summarily dismissed.

Two employees who were busted for driving under the influence of alcohol were fired because in each case it was a second offense.

Another who was cited for public intoxication while walking the street drunk and armed with a bureau-issued weapon received a seven-day suspension.

Improper handling of evidence resulted in suspensions of three and eight days. Shoplifting got a summary dismissal.

CNN posted the documents on http://i2.cdn.turner.com/cnn/2013/images/02/21/office.of.professional.review.-.cnn01302013_0000.pdf.

Microsoft files another anti-bacterial UV tech patent for touchscreens

It should be common knowledge that not all germs are bad for you, but the paranoia?strengthened by anti-bacterial propaganda of many companies?and fear of our micro-friends will continue even if there are studies to prove otherwise.? Anti-bacterial hand wash and sanitizer have become prevalent in many households, and that same concept is making their way to handheld technologies--albeit, a bit more sophisticated.

Microsoft files another anti-bacterial UV tech patent for touchscreens

Microsoft has put in another patent that will deploy the use of UV tech to eradicate harmful bacteria (possibly normal flora, as well) on their mobile gadgets.? The patent submitted by Microsoft basically covers the use UV light to disinfect people?s fingertips if they come in contact with a touchscreen.? Basically, the UV light bounces through a film on or inside the screen, thereby, zapping micro-sized critters without directly blasting every parts of the user.? Keep in mind that Microsoft has been pursuing the anti-bacterial UV tech for quite some time now, and this latest submission is just an improvement on previous proposed methods.

It?s unknown when Microsoft will integrate this method of bacterial annihilation into their lineup of gadgets, but rest assured you don?t have to wait because some hand sanitizer, Windex and toilet papers will do the job just as well.

The lifetime journeys of manure-based microbes

Feb. 22, 2013 ? Studies at the U.S. Department of Agriculture (USDA) are shedding some light on the microbes that dwell in cattle manure -- what they are, where they thrive, where they struggle, and where they can end up.

This research, which is being conducted by Agricultural Research Service (ARS) scientists at the agency's Agroecosystems Management Research Unit in Lincoln, Neb., supports the USDA priority of ensuring food safety. ARS is USDA's chief intramural scientific research agency.

In one project, ARS microbiologist Lisa Durso used fecal samples from six beef cattle to identify a core set of bovine gastrointestinal bacterial groups common to both beef and dairy cattle. She also observed a number of bacteria in the beef cattle that had not been reported in dairy cows, and identified a diverse assortment of bacteria from the six individual animals, even though all six consumed the same diet and were the same breed, gender and age.

In another study, Durso collaborated with ARS agricultural engineer John Gilley and others to study how livestock diet affected the transport of pathogens in field runoff from manure-amended soils. The scientists added two types of manure to experimental conventional-till and no-till fields at 1-, 2-, or 4-year application rates. The manure had been collected from livestock that had consumed either corn or feed with wet distillers grains.

After a series of simulated rain events, the team collected and analyzed samples of field runoff and determined that neither diet nor tillage management significantly affected the transport of fecal indicator bacteria. But they did note that diet affected the transport of bacteriophages -- viruses that invade bacteria -- in field runoff.

Gilley also conducted an investigation into how standing wheat residues affected water quality in runoff from fields amended with 1-, 2-, or 4-year application rates of manure. The scientists found that runoff loads of dissolved phosphorus, total phosphorus, nitrates, nitrogen, and total nitrogen were much higher from plots with residue cover. The team also observed that runoff from fields amended with 4-year application rates of manure had significantly higher levels of total phosphorus and dissolved phosphorus than fields amended with 1-year or 2-year manure rates.

Results from these studies have been published in Foodborne Pathogens and Disease, Applied and Environmental Microbiology, and Transactions of the ASABE.

A Mac User Tries Out Windows 8, Simon Royal, Mac Spectrum

There has been a lot of buzz around Windows 8. About a year ago I was given a half-built PC tower, which I finished off building and gave to my kids. I decided to take advantage of cheap Windows 8 upgrade offer from Microsoft ? but is it an upgrade?

This was a 2 GHz Core 2 Duo tower with 3 GB RAM and originally had an nVidia GeForce 8200GS video card, which I recently swapped out for an AMD Radeon HD 5450 with 1 GB video RAM. It ran Windows XP very nicely. Then I picked up Windows Vista, and despite its bad reputation it ran very well, especially the 64-bit edition.

So how about Windows 8?

Getting Windows 8

Let?s start at the beginning of the whole experience. To qualify for the cheap deal, you need to use the Windows 8 Upgrade Assistant. You need to run it on the machine you want to upgrade. This verifies that your machine qualifies for the cheap deal and then downloads the files needed. Once downloaded, it gives you the option to save an ISO or create a bootable USB stick, which is what I did.

This process didn?t go smoothly for me. The ?creating files? failed and locked up my machine several times. I had to create a new user and restart the download/creating process for it to work. Making the USB stick took a fair amount of time too ? considering it is only a 2 GB file.

Installation

The installation process was one of the smoothest and quickest I have seen for Windows. It is also fairly unattended. I booted from the USB drive, the installer started, and I was shortly faced by a language option and then a drive partition window. I picked which drive I wanted to install to, formatted it and set the installer. Then I sat back and waited.

15 minutes later. I was being asked for my wireless password ? it had detected and installed drivers for my USB wireless adapter throughout the installation process. I logged in to my network and then set up my colour scheme and user account. That was it.

First Impression

I have used every version of Windows since 3.11 and ? despite being a prominent Mac user ? do keep my fingers in the Windows world. As the tech support for my household, building, setting up, and maintaining Windows machines for other family members keeps me fairly up-to-date.

Windows 8 is a totally different look compared to previous versions. The first thing you will notice (and have heard about) is the new tile system, previously called Metro, that you are greeted with on boot up. This is your main interface, and it takes a bit of getting used to.

Windows 8 Start Screen

Here you will find live tiles that update with new content ? such as news updates, Twitter, and Facebook feeds ? as well as big button shortcuts to your apps. It is a giant full screen Start Menu. If you want access to all your apps, right click on the background, and a bar appears at the bottom with a button saying ?All Apps?, which reveals a long list of software already installed on your computer.

Windows 8 Desktop

Click in the bottom left, and you get back your semi-familiar Windows desktop, but you will notice it has no Start Menu, something that has been there since Windows 95. Hovering your mouse to the left, where the Start Menu used to be, will pop up a thumbnail of your giant full screen tile interface, and clicking will bring it back.

Whilst in desktop mode, you have access to your regular look OS with your taskbar at the bottom. Hovering to the top right you will reveal a slide-out menu. This is where things get odd: This slide-out menu will change depending what screen or app you are in. It will give you Search and Settings amongst a few other items.

That is about it. Once you get your head around this twin interface with a few trusty fixtures and fittings moved or removed, you can start to enjoy and work your way round the new OS.

Colour Scheme

Windows 8 is a very bright and vibrant looking OS. The tile interface is big and bold, and the desktop takes the darker more serious look of Vista and 7 and gives it a more updated bold Windows XP look. This is especially noticeable around window edges and dialogue boxes.

Windows 8 Control Panel

The clean, crisp, semi-transparent rounded boxes and pop-ups of Vista and 7 that used Aero have been flattened, squared, and given a childish look.

Speed

The first thing I noticed was how fast Windows 8 is. It is a rare thing these days that a new version of an OS is faster than previous ones.

Windows 8 System Screen

This machine is no snail. It originally had Windows XP on it, and it was a fast machine for running Windows XP. Then I installed Vista for a more modern look and while it was still pretty fast, Vista is a memory and system resource hog, even on a machine with high specs.

Windows 8 turned this around. It is blisteringly fast. It boots in under 15 seconds, and apps load instantly.

Why Am I Talking About Windows?

You might think this is an odd article for a Mac site, but a lot of Mac users live and work in mixed OS environments. Intel Macs can natively boot Windows, and with Apple dropping perfectly good hardware from its new versions of Mac OS X, Windows might be an option for some.

Microsoft claims the minimum spec for Windows 8 is a 1 GHz Pentium 4 with 1 GB RAM for the 32-bit version (or 2 GB for the 64-bit version) and around 20 GB hard drive space. That covers Windows machines running back to the year 2000. I doubt that it will run amazingly well on hardware that old, but at least it will run.

When Apple introduced the Intel Macs in 2006, it started with 1.83 GHz Core Duo machines maxxing at 2 GB RAM. These won?t run Mac OS X 10.7 Lion or 10.8 Mountain Lion (as these require a Core 2 Duo machine), but these will happily run the latest offering from Microsoft. Even the paltry 1.5 GHz Core Solo Mac mini, which struggles with Mac OS X 10.6 Snow Leopard, should run Windows 8 fairly well.

Running Windows on your Mac may not be ideal, but it does mean your ?Vintage Mac? (a term used by Apple and MacTracker) can still run a new OS ? even if it is from the competition.

Of course you could dual boot this new version of Windows with Mac OS X Snow Leopard and boot to Windows when there is something unsupported in your version of OS X.

Would I Recommend It?

This is a two-edged question.

Would I recommend Windows 8 over Mac OS X? Never. Mac OS X is slick, fast, intuitive, extremely stable, and a joy to use. Apple may not have overhauled Mac OS X since its inception in 2000, however that doesn?t mean it is old or outdated looking. The minor changes and tweaks have been welcome on an already fantastic OS.

However, if Windows is your thing and you already have a Windows machine, I would recommend it, despite its childish look and funny new interface. I would recommend it purely on its extreme speed.

However, I do fail to see how this will fit in to the corporate world. Windows 8 does not look very professional, and I can see the tile interface getting in the way.

There are a number of hacks online to make the desktop the default you boot to and also bring back the ?old? Start Menu ? this may be something to look at.

After testing out this new offering from Microsoft, I can hand it over to my children, then happily jump back on my Mac and breathe a sigh of relief. Windows 8 might be fast and good, but it?s not for me full time.

NFL Scouting Combine Preview - NFL Draft

The NFL off-season has only just begun and there is already an upcoming event to speculate and focus on. The NFL Scouting Combine is scheduled from February 23 to 26 and will test prospects in a wide-range of drills. While the 40-yard dash garners the biggest press, the vertical jump, broad jump, bench press, three-cone drill, shuttle run and array of positional drills are used to measure the athleticism of this year's draft class. Scouts, coaches and executives will take this information and apply it toward the 2013 NFL Draft which follows in late April.

All your favorite buzzwords are now in play: upside, length, potential, wingspan, frame, footwork, explosion, football IQ and the list goes on. From the BCS conferences to junior colleges, if a player has game, he will be evaluated whether it is at the Combine, a regional Combine (yes, these exist) or a college pro day.

Each year the Combine can heavily influence the NFL Draft and in this preview, I want to prognosticate about what you might expect from some key players at each position. In addition, I will highlight some possible diamonds in the rough that your team might target in the later rounds or perhaps as an undrafted free agent.

In part one of this two-part series, I will focus on the offense. Look for part two very soon.

QUARTERBACKS

The current prospect evaluations say even the best signal-callers in this class are second rounders at best. All eyes will also be on a solid group of second- and third-round QBs that could vie for higher consideration.

Geno Smith, West Virginia: There are few question marks regarding his arm strength. Look for a lot of questions about his footwork and ability to deliver a consistently accurate throw.

Matt Barkley, USC: Look for his grade to make a slight rebound over the coming months. His experience in a pro-style offense will help. Height, arm strength and throwing while on the move are his chief concerns.

Tyler Wilson, Arkansas: Above-average arm strength needs to be on display. A long delivery is a problem and scouts will want to see him get the football out quick and clean.

Mike Glennon, N.C. State: Huge frame will attract the traditionalists. He must improve his footwork and accuracy at the next level.

Other players to watch: Florida State's E.J. Manuel had a solid career and needs to display better finesse and touch on his short and intermediate routes. Tyler Bray of Tennessee is a hot and cold option with a gunslinger mentality. A poor junior year hurt him. Syracuse QB Ryan Nassib must improve his technique in his lower half. Miami of Ohio's Zac Dysert will often be compared to Ben Roethlisberger and it is a fair comparison, especially since they played at the same school.

Digging deeper: Oklahoma's Landry Jones may have once been considered a top QB prospect, but those days are long gone. He is projected to go in the middle rounds. Another mid-round option is Duke's Sean Renfree. His arm strength should secure him an opportunity as a backup.

RUNNING BACKS

This is considered a down year for the skill positions, but don't be fooled. The high turnover due to injuries can create opportunities for players even in the later rounds. There is talent to be found in the third round and beyond.

Giovani Bernard, UNC: Injury history and inconsistent pass coverage are concerns. He is very explosive as both a runner and receiver.

Eddie Lacy, Alabama: A late scratch to the Combine due to injury. Great north-south runner who can navigate through traffic. (Update: Lacy will not participate in Combine due to a hamstring injury.)

Montee Ball, Wisconsin: Average size and speed, but has been a durable back for the Badgers. Some off-field troubles may hurt him and will have to be addressed during the interviews.

Andre Ellington, Clemson: Terrific speed. Must learn to work between the tackles and not look for the edge. Violent runner that accelerates through the hole with serious burst.

Joseph Randle, Oklahoma State: Upright runner with so-so speed. Must continue to improve in making cuts and using his agility in open space.

Other names to watch: Stanford back Stepfan Taylor is a well-built runner that works well between the tackles, but lacks ideal speed. Le'Veon Bell from Michigan State is a thick player that delivers punishment to defenders. Good footwork and solid vision could make him an ideal "thunder" when paired with a teammate's "lightning." Rutgers' Jawan Jamison is a quick-twitch runner with some injury concerns. Arkansas RB Knile Davis had injury woes in 2011, but the back could rebound his draft stock by putting his speed on display.

Digging deeper: UCLA's Johnathan Franklin and Texas A&M's Christine Michael are two thicker backs that run hard. Oregon's Kenjon Barner could be a mid-round scat back. Mike Gillislee from Florida can run through tacklers and has solid speed and quickness. Pitt's Ray Graham and Vanderbilt's Zac Stacy are two shorter backs that run with tenacity and produced well while healthy.

RECEIVERS & TIGHT ENDS

While lacking a blue-chip receiver, the 2013 draft class runs deep. There should be a run on receivers and tight ends late in the second round and into the third.

Cordarrelle Patterson, WR, Tennessee: An after-the-catch monster who will only improve once he cleans up his route-running. Must show more reliable hands.

Keenan Allen, WR, California: The safest choice for those looking for a No. 1 receiver. Height, length and hands are all excellent. Improvement in his separation skills are his primary concern. (Update: Allen will not participate in the Combine due to a knee injury.)

Tavon Austin, WR, West Virginia: A true game-breaker with the ball in his hands. Undersized and lightning quick. Allows the ball into his body too often.

Justin Hunter, WR, Tennessee: Athletic specimen who also excelled in track and field. Could have highest potential among his peers. Route-running is very raw.

Tyler Eifert, TE, Notre Dame: Can line up out wide and is a natural receiver. In-line blocking is average and will likely need to add more strength. Huge frame.

Zach Ertz, TE, Stanford: Another big target at his position. Long arms, good blocker and can work the middle of the field. A well-balanced prospect who needs to run well.

Other names to watch: WR Aaron Dobson from Marshall has tremendous hands and can pluck it away from his body while airborne. Louisiana Tech's WR Quinton Patton is a great route runner with excellent hands. Baylor's WR Terrance Williams is a natural athlete with raw skills across the board. WR DeAndre Hopkins of Clemson is a bit undersized, but does almost everything well on the football field. USC's WR Robert Woods displayed a lack of concentration at times and his lean frame will need to grow.

At tight end, Jordan Reed of Florida will be compared to Aaron Hernandez. He can line up almost anywhere on the field and has noticeable athleticism and fluidity for the position. San Diego State's Gavin Escobar will need to run well considering his size and weight.

Digging deeper: Oregon State's WR Markus Wheaton has adequate speed and route-running to become a solid No. 2 receiver. WR Cobi Hamilton from Arkansas has a great frame and good length. Long strider who can work downfield and work the route tree. Washington State's Marquess Wilson played some quarterback, but is a natural athlete who may just need time to develop at the next level. Virginia Tech's Marcus Davis and Rutgers' Mark Harrison are two excellent athletes that both played in unreliable offenses. Both players could surprise once teamed with a NFL quarterback. Texas A&M's Ryan Swope is a steady receiver with a great all-around game.

TE Vance McDonald of Rice and Michigan State's Dion Sims are two big bruisers. Both will need to have solid 40-times to ensure they can not only block, but gain separation. Stanford's Levine Toilolo is 6'8" and moves well for his size with great hands. Travis Kelce from the University of Cincinnati is one of the better athletes at his position and must show he can hold his own as an in-line blocker.

OFFENSIVE LINE

An offensive lineman has not been the No. 1 pick since OT Jake Long was selected by the Miami Dolphins in 2008. That could finally change this year, but it is still too early for anything except speculation.

Luke Joeckel, OT, Texas A&M: Superior technique and footwork could make him the No. 1 pick. Strength is only adequate and must improve.

Chance Warmack, OG, Alabama: One of the best guard prospects in years. Might be the best prospect at his position in this class. Few holes in his game.

Eric Fisher, OT, Central Michigan: Excellent Senior Bowl could make him a Top 10 pick. A lean player that moves extremely well in open spaces. Strength is lacking.

Lane Johnson, OT, Oklahoma: Quick riser on the draft boards. Limited experience as offensive lineman. Very tall and must remain low to maintain consistent leverage.

Jonathan Cooper, OG, UNC: Excellent in the open field. Elite footwork. Average size and strength, must improve long-term.

D.J. Fluker, OT, Alabama: Likely limited to right tackle only. Needs to maintain a healthy playing weight. Powerful, but his movement skills look limited.

Larry Warford, OG, Kentucky: Less than ideal height. Sluggish release off the line. Great bender and technician. Could contribute immediately.

Other names to watch: Tennessee OT Dallas Thomas may eventually transition to guard due to below-average footwork. C Barrett Jones of Alabama is one of the most highly-decorated linemen to enter the draft in years. Virginia OT Oday Aboushi lacks the strength to play right tackle and may need a year of grooming to take over at left tackle. Syracuse OT Justin Pugh is excellent in pass protection and could afford to add some bulk and will probably play guard at the next level. Oregon OG Kyle Long is the son of former Oakland Raiders DT Howie Long and brother of current St. Louis Rams DE Chris Long. He will make a name for himself in the NFL.

Digging deeper: Kent State OG Brian Winters is quick off the line and possesses active hands to disrupt defenders. Off-field concerns could hurt Illinois OG Hugh Thornton. Florida State OT Menelik Watson is a terrific athlete that may be best-suited for a zone-blocking scheme. OT Terron Armstead of Arkansas Pine Bluff, a Southwestern Athletic Conference school, is rapidly moving up draft boards. OG Garrett Gilkey is a Division II prospect from Chadron State who formerly played tackle.

It's a deal! OfficeMax, Office Depot to merge

Is there a deal or isn't there? Apparently there is.

The boards of Office Depot and Office Max confirmed Wednesday that they agreed to combine the two companies in a $1.2 billion, all-stock deal that could alter the balance of power in the office supply retail market.

The boards of both companies approved the deal after a confusing morning in which the deal was announced prematurely.

The deal, one of several large-scale acquisitions announced within the last week, had been buried within Office Depot's fourth quarter earnings release, which is not a typical way that companies trumpet a deal of this size. A source told Reuters that the statement had been a draft and that, at the time, the deal was not yet completed.

Under the terms of the deal, OfficeMax stockholders will receive 2.69 Office Depot common shares for each share of OfficeMax common stock. In a joint statement, the office suppliers said the new company would be valued at $18 billion. The new company would have an equal number of Office Depot and Office Max directors on its board.

The two companies are competitors to Staples, the world's largest supplier of office goods. The deal may be an attempt by both OfficeMax and Office Depot to become more competitive with Staples, even as they confront declining market share and consumers that move to buy online.

PFT: Bowers' lawyer confident he'll be exonerated

020411-gamble-header_crop_exact

The process of the Eagles hiring Tom Gamble as their vice president of player personnel took longer than he hoped, but the former 49ers personnel man said the time was right this year.

Gamble said there were several reasons why he wasn?t able to join the Eagles a year ago, but that his rare mid-offseason jump made sense this time. He interviewed with general manager Howie Roseman about the job formerly held by Colts GM Ryan Grigson last year, but was able to talk his way out of the 49ers for what amounted to a lateral move.

?The timing wasn?t right [last year] for a lot of different reasons, some professional, some family,? Gamble said, via Les Bowen of the Philadelphia Daily News. ?Then this whole thing came up again. I have enough relationship with Howie, enough dialogue. Living out in Pac 12 country, I?ve got a lot of respect for Chip Kelly ? I?ve been in and out of his [Oregon] building, he?s been in and out of [the 49ers'] building, I think he?s a hell of a football coach.?

?We chatted again, and you know what, it was time. I was real excited about it. Again, I wasn?t looking to go anywhere; I was in a great situation with some great people ? as good as it gets in this business.?

The primary lure for Gamble was a return home. His father Harry was the Eagles president in the 1980s when the son got into the family business.

?It?s Philadelphia. That means something,? Gamble said. ?It?s a little bit different, this thing. There?s not a lot of movement, not a lot of opportunity. I didn?t know when it would come up again, and I was ecstatic to come back.?

Gamble indicated that the 49ers were hesitant to let him leave a year ago, but agreed that if the opportunity presented itself again, they?d give him a chance.

Gamble interviewed for other GM jobs, but even though he lacks that title in Philadelphia, he?ll have significant input. Roseman doesn?t have the classic personnel evaluation background, and with Kelly having no NFL experience, getting Gamble on board is a solid move for the organization.

A Hudson, Ohio Lawyer's Perspective on Divorce and Family Matters: Mom and Dad (and Mom): Florida Judge Approves Unconventional Family

Mom and Dad (and Mom): Florida Judge Approves Unconventional Family

A family court judge in Florida recently authorized the reissuance of a 22-month-old girl?s birth certificate. No big deal, right? After all, birth certificates get reissued all the time due to clerical errors or name changes. In this case, the reissuance was not because of any old typo. Instead, the toddler would be getting a third parent. The case starts with a lesbian couple, Maria Italiano and Cher Filippazzo. The two had been considering having a child for a while when they met a new friend, a Miami hairdresser named Massimiliano Gerina. Gerina, a gay man, became fast friends with the duo. After a while the two approached Gerina and asked if he?d consider donating sperm to allow the two to have a child. At first he shrugged off the offer, but after some lengthy consideration he decided he was game. The only condition to his participation was that Gerina wanted to play an important role in the child?s life. Not content to be an anonymous sperm donor, Gerina wanted to have visitation rights and get to know his child. The lesbian couple was on board and the three reached a verbal agreement laying out Gerina?s rights and responsibilities.
Things, unfortunately, got complicated the moment the child was born. Florida law (and the law of most other states) says that sperm donors have no parental rights to their biological offspring. As a bit of an aside, here in Ohio if the couple receiving the sperm knows the donor, the donor is only released from legal responsibility for the child if the procedure is performed with a physician?s involvement. Florida has no such law and Gerina would ordinarily have no rights or responsibilities for the child, something the lesbian couple eventually decided they agreed with. Going back on their verbal agreement, the couple now prevented Gerina from seeing the girl, denying him the role he felt he?d been promised.
Gerina, in turn, filed suit seeking to enforce their original verbal agreement. The Florida judge who presided over the case eventually sided with Gerina, at least on most issues. The lesbian couple will maintain sole parental rights to the child and Gerina will not be expected to pay child support. However, Gerina has been given visitation rights to the girl and has also been allowed to have his name listed on the child?s birth certificate.
