Home nursing agency settles federal wage dispute ? Business ...

Extended Health Care Private Duty Nursing, a Los Angeles-area home nursing agency, has agreed to pay $654,082 to settle a Fair Labor Standards Act complaint that followed a federal probe into its pay practices.

A U.S. Department of Labor Wage and Hour Division (WHD) investigation revealed the company had paid some of its employees ?straight time? even when their hours exceeded 40 per week. Federal investigators said that even some of the company?s longest-tenured employees received only time and one-quarter for their overtime hours.

Some employees did receive overtime at the required rate of time-and-one-half?but only if they worked more than 80 hours in a biweekly payroll period.

The investigation also determined the company misclassified some employees as independent contractors. In addition, EHC faced record-keeping violations.

In all, 108 nurses will recover back pay under the settlement agreement.

Note: The IRS and WHD are taking a close look at independent contractor classification issues. Have your attorney regularly evaluate your independent contractor relationships to ensure they comply with the law.

30+ Auckland University Students Occupy Staff Rooms Demanding Fees Freeze

(UPDATED) Just chatting on the phone with a student who is currently barricaded inside the Clock Tower of Auckland University, occupying the staff rooms in solidarity with anti-austerity protesters worldwide.

Their message to the world is that New Zealand has the 7th highest university fees in the developed world, with fee increases averaging 4% per year while the funding for most courses has been raised only 0-0.5%.

With 15% of students living in poverty, Auckland University students have decided to fight back.

It is a little known fact that Auckland University students were the first occupiers in New Zealand; occupying the clock tower 2 days prior to the inception of Occupy Wall Street in New York on September 17th, 2001.

Today?s action is undertaken on October 15th (NZDT) which is the one year anniversary of the establishment of major occupations throughout New Zealand. ?It is the second ?Fight The Fees? action in a week; the first being a takeover of Princes Street on Wednesday October 10th, 2012.

After arriving at a ?public meeting? to discuss the fee increases this afternoon, the students discovered all the doors were LOCKED to deny them the ability to participate in the meeting.

Subsequently, they entered and barricaded themselves into the Clock Tower staff rooms in protest.

There are currently reports that two female students have been assaulted by four campus security guards, and that the students chanted their way out of the Clock Tower and all the way to the doorstep of the Vice Chancellors Office, which was lined with police.

Saturday?Izakaya: Tsukune

At JapanCulture?NYC we?re launching a new, occasional feature called Saturday?Izakaya.

You may have noticed that we?ve been doing a lot of cooking lately, so we?ll attempt to recreate some of our favorite izakaya food and drink experiences.

Delicious Tsukune at Village Yokocho

We decided our first Saturday?Izakaya installment would be tsukune.

What is?Tsukune?
Makiko Itoh, author of the Just Bento Cookbook and creator of the websites Just Hungry and Just Bento, says that tsukune means ?kneaded and shaped into a round shape.?
Generally cooked yakitori-style with skewers, these chicken meatballs can also be pan fried or stewed or even baked.

Since we already had a good idea of what goes into tsukune, we thought we?d take ideas from a couple of recipes and ultimately create our own. WARNING: This act of kitchen confidence far exceeds actual kitchen ability.

For the base of our tsukune, we referred to a recipe we found on eatingwell.com, and for the tare, or sauce, we looked to JapanFoodAddict.com.

We took a few liberties with measurements for our tsukune, and our actual recipe turned out like this:

JapanCulture?NYC?s Tsukune

  • 2 lbs ground chicken
  • 1 cup panko
  • 5 shiitake mushrooms (stems removed)
  • 1 egg
  • Chopped scallions
  • 1 tsp sea salt
  • 1 tsp ground black pepper
  • 2 tsp grated ginger
  • 2 tsp garlic powder
  • 2 tsp honey
  • Canola oil for cooking

For the tare:

  • 1 ? tsp soy sauce
  • 1 tsp mirin
  • 1 tsp sake

How did it turn out? Let?s roll the videotape:

As you can see, it wasn?t exactly what we?d find at an izakaya, but it tasted pretty good.

The Verdict: We?ll certainly try again, but in the meantime, we?ll probably just go to our favorite izakaya in the city. Stay tuned for more Saturday?Izakaya!
